Love by K General Conditions

These General Conditions are intended to regulate the Terms of Use and General Conditions of Online Sale by which the store Lisa Quintas Unipessoal Lda, legal entity with TIN 510165338, with registered office at Rua Campo Alegre, 830, 9th floor, 4150-171 Porto (from now on "Love by K") shall be governed.

The Love by K service consists of the availability and supply of a set of products and/or services, to allow the user, i.e., the client, to order and purchase online, the products presented therein. The same applies to sales through our social networks - Instagram and Facebook.

Using Love by K implies full acceptance and agreement of all parameters present in the Terms and Conditions described, as well as the Privacy Policy and Cookies in force at the time you access Love by K.

If you do not accept, in part or in full, any of the conditions stipulated, you should refrain from shopping at Love by K. If you access Love by K, you are committing and responsible to respect the conditions set out on this page and the Privacy Policy.

Changes in service and prices

Love by K reserves the right to update and/or amend the Terms and Conditions without prior notice.

Likewise, Love by K reserves the right to change the presentation and content of the site at any time, at our sole discretion. It is advisable to periodically check the Terms and Conditions to ascertain any changes or updates. Your continued use of or access to the Website following any changes constitutes acceptance of such changes.

Product and Price Information

Love by K informs customers of the features, descriptions, images or videos of each product and/or service on each page made available. Love by K undertakes to provide its products and/or services clearly and to correct any errors that may occur as soon as possible.

Love by K presents, concisely, the prices of each product and/or service, including VAT rates, shipping costs applied to each order and other additional costs that may be applicable.

We have made every effort to ensure the accuracy of the images of the items presented on this website and on our social networks. We cannot guarantee that your computer/iPad/mobile screen will be able to reproduce the colours in the same way.

Information about products, prices, content, images, videos, promotional campaigns and services may be updated and changed by Love by K at any time. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuation of the service.

Intellectual Property

Love by K is a registered online shop, being the service provided is the responsibility of Lisa Quintas Unipessoal Lda.

The content, domain, and information present and available on Love by K, such as images, logos and texts, are the exclusive property of Lisa Quintas Unipessoal Lda or third-party owners of the same who duly authorize their inclusion in the site, and are therefore protected by copyright and related rights. Any use, reproduction, copy or disclosure of visual, audiovisual or written content is subject to prior approval by Love by K.

The client undertakes to fully respect the conditions and rights referred to as well as to refrain from acts that may go against the law and rights such as copyright, and related rights, among other legislation applicable to the use of images, videos, content, etc. without the express approval of Love by K. Love by K may not be held liable for any improper use of such products.

Payment Methods

The customer has at his disposal the following forms of payment:

Multibanco - After validating the order you will receive an email with the ATM reference for payment (as "Payment of Services") through an ATM terminal or home banking. This payment method is only available in Portugal. Your order will be processed shortly after your payment order is received and you do not need to send proof of payment.

MBWay - The payments via MBWay should be made to the number +351 962408494 (mobile network). This is an easy, fast and secure way to pay for your purchases at Love by K. Please indicate the order number as the reference for the transfer.

Credit Card - If you choose this payment method, for security reasons the order will go through an authorization process. After validating the order you will be redirected to enter your credit card details and make the payment.

Bank transfer (national and international) - After validating the order you will receive an email with the NIB or IBAN and all necessary information to make the transfer. In the case of international transfers, the customer will have to pay all the costs of the bank transfer and, if applicable, the costs of currency exchange (when applicable).

Please send proof of the transaction to info@lovebyk.com. Your order will not be shipped until confirmation of the amount in our account.

After the payment is completed, Love by K will proceed with a standard verification, so that it is possible to process and send the order. The customer will receive an email with the confirmation that the order is paid, as well as the corresponding invoice.

Conditions of the purchase at Love by K:

Availability of products

All product orders are subject to availability. Despite all our verification efforts, it is sometimes possible to have a stock rupture.

If the product is no longer available after the purchase has been completed, Love by K will contact the customer by phone or e-mail as soon as possible to expedite the process with the same. The client may choose to refund the amount, exchange for another similar article or wait for the availability of the article.

Sales prices

The prices practised in the online shop are presented in euros (EUR) and include VAT at the rate in force in Portugal (23%). The prices indicated do not include shipping costs. The advertised prices are valid at the time of consultation unless occurrence of printing, typographical errors, or out-of-stock. Love by K reserves the right to change prices and other specifications at any time. It is possible that, in extraordinary situations, the information on prices is wrong. If this situation occurs, Love by K reserves the right to cancel the order.

Cancellation of the order

The customer may cancel an order placed while it is being processed. Please inform Love by K through the following email contact: info@lovebyk.com or by phone/sms/WhatsApp to the number (mobile network): + 351 962408494.

If the cancellation request has been made after the order has been shipped, it will be forwarded for delivery and the customer may choose to refuse to accept it. Love by K is not responsible for possible delays in handling the cancellation of orders.

Right not to accept an order

Love by K reserves the right to refuse and cancel any purchase made through the site (even if it has already been confirmed), in the following situations and without any liability for damages or costs, namely:

- The product is no longer available (we return the payment);

- There is a previous dispute with the customer;

- The billing information is not correct or verifiable;

- The order is found to be incorrect or susceptible to fraud;

- If we detect that the price indicated on the website is incorrect;

- Payment of the order is not received within 3 working days of acceptance of the order;

- If we are unable to deliver to the indicated address;

- If we have evidence that the consumer is under 18 years of age, or

- If we have evidence that the consumer is not a final consumer.

Although our website is run with the utmost care, we are not immune to errors. We, therefore, reserve the right to cancel or modify any order where there is an error in the description or price. Free Termination

The client has the right to terminate the contract within 14 (fourteen) days from the date of the conclusion of the contract.

If the customer wishes to terminate the contract, you may do so by emailing info@lovebyk.com or by filling out the contact form available at Love by K.

By terminating the contract within the legal period, in addition to returning the product, the customer must return any offers that accompany the main product. Love by K shall refund the amount paid within 14 days of receipt of the returned order accompanied by the purchase invoice, proof of payment and return form.

The refund will be made through the same method of payment used by the customer in the initial payment, except in situations of express agreement and in which the customer does not incur any costs as a result of the refund.

Any refund procedure will be processed as provided for in the legislation in force in the Decree of Law No. 24/2014.

Complaints

The customer may submit a suggestion or complaint regarding any question, act, information or service provided concerning Love by K through the email contact info@lovebyk.com or through the electronic Complaints Book (see link on the home page).

Limitation of Liability

Love by K may only be held liable for any fault that is exclusively attributable to it. If the applicable law does not stipulate otherwise, our liability is limited and we shall not be liable for indirect damages resulting therefrom; loss of exploitation, loss of benefit, loss of opportunity, damage or fees that may arise from the fact of purchasing any product presented on our website.

By creating and using an account on Love by K, the customer is responsible for account maintenance, confidentiality and all activity arising from their account.

The Love by K is not responsible for any information disclosed by third parties, technical failures or any other problems that prevent access and proper functioning of the online shop.

Love by K is not responsible for possible damage, directly or indirectly related to the use, or inability to use, the products and/or services provided, as well as for any delay or unforeseen in the delivery of orders.

The Love by K is not responsible for damages that occur during the delivery of the order, nor for losses that occurred, being these the responsibility of the respective carriers.

Force Majeure

We shall not be liable for any delay or failure in the performance of any of our obligations under a contract caused by events beyond our control, including, but not limited to, the following: strikes, war, terrorist attack, explosion, storm, earthquake, flood, fire, epidemic or any other natural disaster.

Love by K shall not be liable for damages and inconveniences arising from the use of the Internet, including, for example, as a result of the breakdown or deficiency of service and access, outside intrusion or presence of computer viruses, or any case of force majeure.

Legislation

These General Conditions of Sale as well as the contractual relations between Love by K and the Customer shall be governed by Portuguese Law.

In the absence of a resolution by agreement between the parties, any dispute arising from any agreements or documents to which these General Conditions of Sale apply shall be submitted to the competent courts of Portugal or a conflict arbitration centre.
